In consideration of the promises and statements to follow herein, iResQ Rescue &
Rehabilitation (Rescuer) and the undersigned (Adopter), having read
and in full understanding, do willingly enter this Agreement with the intent to be legally bound
by this Agreement and hereby consent and agree to the following:
The Adopter hereby understands, promises, and agrees, whereupon receiving the animal to
indemnify, forever release, discharge and hold harmless Rescuer from any and all actions,
causes of action, suits, debts, duties, claims and demands resulting from any action or
omission arising out of any cause whatsoever and without limitation and particularly as related
to the adoption of:

Rescuer acknowledges receipt of a an adoption donation as reimbursement to aid with veterinary, transportation, nutritional and other expenses incurred by the Rescuer for the pet, in the amount of :
Hereinafter referred to as "this pet" or the "pet". The Adopter hereby declares that neither representations about the nature of the adopted pet, nor any representations regarding the nature and extent of legal liability, or of financial responsibility have induced the adopter to sign this contract.
The Adopter hereby acknowledges the following provisions as defined:
FEE: The NON-refundable donation is not a sale price, but requested to defer or reimburse Rescuer for any medical expenses, or any other expenses incurred by the pet or Rescuer to consider the pet for adoption. NO refunds in whole or part for any reason!
TRANSFER OF OWNERSHIP:
The pet shall not be sold, given to, or adopted to anyone else, nor shall there be any transfer of ownership to any firm, corporation, or organization of other homeless animals, such as another rescue facility, research facility
animal adopted from Rescuer must be returned to Rescuer if for ANY reason the Adopter can no longer keep it. Violation of this agreement will result in court costs and attorney fees payable by the Adopter for all costs necessary for the Rescuer to redeem the pet.
The pet, if adopted as a puppy/kitty shall complete the booster series of 3 shots along with a Rabies. Adopter agrees to ensure completion of series. All pets must have yearly booster shots and the Rabies vaccines. Renewal of the Rabies vaccine is required by law and therefore by the terms of this contract, unless contraindicated for health reasons.
Adopter agrees to obtain immediate vet care for the animal should it become sick or injured and takes full financial responsibility for such care as of the time this contract is signed and pet is in your possession.
IMPORTANT NOTICE – TEMPERAMENT:
Rescuer makes no explicit or implicit guarantees in reference to the health and/or temperament of the pet. The pet is adopted "as is" and the
Adopter assumes all responsibility
for treatment of any and all existing conditions, or any other conditions of physical or temperament changes that may occur. Rescuer will provide the pet with the above required vaccines before adoption if the age and current health of the pet permits.
While the Rescuer makes every effort to place for adoption healthy animals, rescued animals - especially puppies and kittens get sick very easily & quickly, so Rescuer cannot guarantee the health of any animal beyond what is currently observable by the Rescuer and yourself as Adopter, at the time of adoption, therefore Rescuer shall not be held responsible for any medical expenses which may be incurred after animal is in the possession of Adopter.
It is hereby expressly excluded any implied warranties of merchantability or fitness for any particular purpose, including and without limitation, any warranties regarding health or temperament, including whether the pet is housebroken/litter trained.
ADOPTER'S ACKNOWLEDGMENT OF TERMS
The undersigned Adopter hereby acknowledges receipt of the above described animal and
therefore agrees to the following terms:
The pet will not be allowed off leash except within adequate fencing.
The pet will not be chained to a doghouse or tied outside to any type of object or
The pet is not to live in a garage, doghouse, or any type of outbuilding.
The pet is (or will soon be) microchipped for identification and will wear a collar or harness
with an ID tag reflecting the Adopter’s
contact information and proof of rabies at all
Adopter agrees to obtain the proper municipal license required under local law.
The pet is
NOT to be left unsupervised with children or other animals at any time
The pet is to have food, water, and shelter at all times. That includes protection from both
hot and cold weather which could endanger the health of the animal.
The Adopter shall refrain from any type of abuse of the animal and from otherwise treating the pet
in a mean, cruel or physically rough manner.
The pet will never be left alone in a car or ride in the back of a truck without proper restraint.
If for any reason the Adopter no longer wants or is unable to further care for the animal, the animal will be returned to iResQ assuming there is no history of aggression and the Rescue has an open foster home to accommodate the animal.
If any Agreement or Term is broken
adoption criteria is not fulfilled by the Adopter, including but not limited to; paying the adoption donation, completing the adoption application & agreement, keeping spay/neuter appointments OR if for
other reason, Rescuer determines the pet is at risk with the Adopter, the pet may be seized from Adopters home and
Adopter agrees, by signing this contract, to waive the right to court action
, thus returning the pet to the care and possession of the Rescue and Adopter will be responsible for any and all costs associated with such action.
All donations are final and non-refundable.
However, in the event that a pet is returned and by Adopter request, Rescue can provide a statement of donation which may be at some point considered for tax purposes.
Colorado state law requires all unaltered dogs/cats be spay/neutered within 90 days of adoptions and requires a deposit be taken as promise of action. In adherence to that law, iResQ requires a $100 deposit and approval by the Board. iResQ also attempts to have all dogs spay/neutered within the first 2 weeks of adoption and
Adopter agrees to attend ALL appointments as scheduled for the animal. This includes immediate sterilization and follow up appointments, even if not convenient.
Failure to meet iResQ scheduled appointments will result in forfeiture of the deposit, immediate seizure of the dog or both, returning it to the care and possession of the Rescuer without refund or recourse to the Adopter.

This is a confidential agreement between the Adopter and the Rescuer.
RIGHT OF OWNERSHIP
The pet adopted from the Rescuer is the "sole property" of the rescue, and has been
surrendered as such by private owners or animal facilities that have signed a statement
agreeing that the above mentioned dog is not owned property of any other person, firm or
organization. Rescuer shall not be held liable, charged, or chargeable for any
misrepresentations unknown to this Rescuer.
